What Are Affected Suppliers (Berørte leverandører, Norway)?

This is a Norwegian procurement term. Suppliers who took part in the competition and therefore have the right to notification, reasons and a right to challenge the award.

Who counts as an affected supplier?

Suppliers that took part in the competition and have not been finally rejected. They must be notified of the award decision and given the reasons for it.

What rights does an affected supplier have?

To receive the award decision with reasons, to see how the bids were evaluated, to complain to the buyer during the standstill period, and to bring the matter to KOFA or the courts.

Does a rejected supplier still count as affected?

Yes, until the rejection is final. A supplier rejected earlier in the process must also be told the reasons, so it has the chance to challenge that decision.
