What Is an Application for Review (Nachprüfungsantrag, Germany)?
This is a German procurement term. A bidder's formal application to the procurement chamber for a review of a procurement procedure.
Who can apply for review?
Any company with an interest in the contract that claims a breach of procurement rules has harmed or may harm it. It must first have raised the breach with the buyer as a formal complaint.
What is the deadline?
Fifteen calendar days after the buyer rejects the complaint, and in any case before the contract is signed. After signature, review is normally no longer possible.
Does the application stop the award?
Yes. Once the procurement chamber informs the buyer of the application, the buyer may not sign the contract until the chamber has decided.
