What Is the Ban on Negotiation (Forhandlingsforbud, Norway)?
This is a Norwegian procurement term. The prohibition on negotiating with suppliers in open and restricted tender competitions.
Which procedures does the ban apply to?
Open and restricted tender competitions. In those, the buyer cannot negotiate on price, terms or the content of the bids after they have been submitted.
What is the buyer still allowed to do?
Ask for clarification of unclear points and have obvious errors corrected, as long as this does not change the substance of the bid or give one supplier an advantage.
Why does the ban exist?
It keeps the competition equal and predictable. If negotiation were allowed, the bid a supplier submitted would no longer be what it is judged on.
