What Is a Body Governed by Public Law (Offentligrettslig organ, Norway)?

This is a Norwegian procurement term. An entity set up to meet needs in the general interest, and mainly financed or controlled by the public sector.

What makes an entity a body governed by public law?

It is set up to meet needs in the general interest and not of an industrial or commercial nature, it is a legal person, and it is mainly financed, controlled or managed by the public sector.

Why does the classification matter?

Because such bodies must follow the procurement rules even if they are organised as private companies. Many municipal companies, housing associations and student welfare organisations fall into this category.

How do you know whether a particular company is covered?

By testing it against the three conditions. The deciding factor is usually whether the entity operates under normal commercial risk, or whether the public sector will step in if it runs into difficulty.
