What Is Budget Law (Haushaltsrecht, Germany)?
This is German law. The law of public budget management, from which German procurement law historically developed.
What is Haushaltsrecht?
The law governing how public bodies manage their budgets, including the requirement to spend economically and efficiently. German procurement law below the EU thresholds developed from it.
Why does it matter in procurement?
Because below the thresholds, the duty to procure through competition rests on budget law rather than on the GWB. The UVgO and the VOB/A section 1 are applied through budget rules.
Does it give suppliers rights?
Only indirectly. Budget law binds the authority internally. A supplier cannot invoke it before the procurement chamber, but can in the civil courts in limited cases.
