What Is the Cancellation of a Tender (Aufhebung der Ausschreibung, Germany)?
This is a German procurement term. The termination of a procurement procedure without an award, for objective reasons.
When can a tender be cancelled?
When no bid meets the requirements, when the basis for the procurement has changed materially, when there is another serious reason, or when all bids are uneconomic.
Must the buyer explain?
Yes. The bidders must be informed of the cancellation and the reasons without delay.
Can bidders claim compensation?
If the cancellation was not justified, bidders can claim the costs of preparing the bid. A justified cancellation gives no claim.
