What Is a Cancelled Procurement (Avbruten upphandling, Sweden)?

This is a Swedish procurement term. Where the contracting authority ends a procurement without signing a contract; this requires objectively acceptable grounds and the decision can be challenged.

What reasons are enough to cancel a procurement?

Acceptable reasons include no bids meeting the requirements, bids significantly exceeding the budget, a change in need, or errors in the procurement documents that affect competition. The reasons must not be a pretext for favouring or disadvantaging a particular supplier.

Does the authority have to explain why the procurement is cancelled?

Yes. The authority must inform bidders and candidates of the decision and the reasons for it as soon as possible.

Can you challenge a cancellation you think is wrong?

Yes. A supplier can apply to the administrative court for a review of the decision, and the court will assess whether the authority had objective reasons.
