What Is the Competition Principle (Konkurranseprinsippet, Norway)?
This is a Norwegian procurement term. The requirement that procurements be based, as far as possible, on genuine competition in the market.
What does the competition principle require?
That procurements are based, as far as possible, on genuine competition. The buyer must not design the competition so that it favours a particular supplier.
How can a requirement breach the principle?
By being written so narrowly that only one product or supplier can meet it, without the need justifying it. Referring to a specific brand without 'or equivalent' is the classic example.
Does the principle apply below the thresholds?
Yes. Competition is a basic principle of the Public Procurement Act and applies to all procurement covered by the Act, including below the national threshold.
