What Is a Competitive Procedure with Negotiation?

A procedure in which the buyer may negotiate with suppliers on the content of their bids before the contract is awarded.

What can be negotiated?

The initial bids, to improve their content. The minimum requirements and the award criteria cannot be negotiated.

Does the buyer have to negotiate?

No. The buyer can reserve the right to award on the basis of the initial bids without negotiation, as long as this was stated in the notice.

How does it differ from competitive dialogue?

In this procedure the buyer has already defined the need and the bids are negotiated. In competitive dialogue the solution itself is developed through dialogue before any bid is submitted.
