This is a German procurement term. A declaration to keep confidential information from the procurement procedure secret.
When is a Vertraulichkeitserklärung required?
In procurements involving sensitive information, such as IT security, defence or personal data. It is submitted with the request to participate or the bid.
What does it commit the bidder to?
Not disclosing the documents and information from the procedure, and ensuring that employees and subcontractors do the same.
What if it is missing?
The request or bid may be excluded, or the buyer may ask for it to be submitted within a deadline, depending on how the tender documents treat it.
