What Is a Confidentiality Marking (Sperrvermerk, Germany)?
This is a German procurement term. A note marking certain documents as confidential.
What is a Sperrvermerk?
A marking on documents or parts of a bid identifying them as trade secrets that must not be disclosed, for example to competitors in a review procedure.
Does marking guarantee confidentiality?
No. The buyer and the review body decide whether the information is genuinely a trade secret. Marking everything confidential is routinely disregarded.
What should be marked?
Specific information whose disclosure would harm the bidder: calculation methods, supplier prices, technical know-how. Not the whole bid.
