What Is a Conflict of Interest in Procurement?

A situation where someone involved in a procurement has interests that could compromise their impartiality.

What must buyers do about conflicts of interest?

Take reasonable steps to identify and keep conflicts under review, and take steps to mitigate them. For covered procurements, a conflicts assessment must be prepared before the tender notice is published.

Can a conflict lead to a supplier being excluded?

Yes, if the conflict gives that supplier an unfair advantage that cannot be avoided by other means. The supplier must first have a chance to show it does not.

What should suppliers declare?

Any relationship that could look like a conflict, such as former employees now working for the buyer or advisers involved in preparing the procurement. Declaring early is better than having it found later.
