What Is Contract Set-Aside?
A court remedy that can undo a contract awarded in breach of the rules, replacing the old concept of 'ineffectiveness'.
When can a contract be set aside?
Typically when it was awarded in breach of key rules, for example a direct award without proper justification or entering the contract during the standstill period.
Who can apply?
A supplier that has suffered, or risks suffering, loss because of the breach, by bringing proceedings in court within strict time limits.
Is set-aside the only remedy?
No. Courts can also award damages or order the buyer to correct the procurement before the contract is entered into.
