What Is a Declaration of Availability (Verfügbarkeitserklärung, Germany)?
This is a German procurement term. A third party's declaration that it will make its capacities available to the bidder.
When is a Verfügbarkeitserklärung needed?
When a bidder relies on a third party's resources, such as a subcontractor's equipment or a parent company's finances, to meet the suitability criteria.
What must it say?
That the third party will make the specific resources available for the contract. A general statement of goodwill is not enough.
Does the third party have to be suitable?
Yes, for the capacity it provides, and it must not be subject to exclusion grounds. The buyer can require it to be replaced if it is.
