English

What Is Disproportionate Effort in Procurement (Unverhältnismäßiger Aufwand, Germany)?

This is a German procurement term. Effort that is out of proportion to the benefit that can be achieved.

Where does unverhältnismäßiger Aufwand matter?

When a buyer can decline to do something the rules otherwise require because the effort would be out of proportion to the benefit, for example checking every bidder's documents in full or dividing a contract into lots.

Who decides?

The buyer, but it must document the reasons in the procurement file and the decision can be reviewed.

Can a bidder rely on it?

Rarely. It is a justification available to the buyer, not a right of the bidder.
