What Is the Duty of Oversight (Påseplikt, Norway)?
This is a Norwegian procurement term. The buyer's duty to monitor that suppliers and subcontractors actually comply with pay and working-condition requirements.
What does the duty of oversight require?
That the buyer actively checks that suppliers and subcontractors are complying with the requirements on pay and working conditions, rather than relying on the supplier's own declaration.
How is it carried out in practice?
Through risk-based checks: requesting pay slips and employment contracts, site inspections, and reviews of the subcontractor chain. The buyer must have a system for this, not just a clause.
What happens if a breach is found?
The buyer can require the breach to be put right, withhold payment, impose penalties under the contract, and ultimately terminate the contract.
