What Is the Duty to Complain Promptly (Rügepflicht, Germany)?
This is a German procurement term. The bidder's duty to raise a recognised procurement breach without delay.
What is the Rügepflicht?
A bidder's obligation to raise a recognised breach of procurement rules with the buyer within ten calendar days of recognising it. Without a complaint, an application for review is inadmissible.
What about breaches visible in the notice or documents?
They must be raised by the application or tender deadline at the latest. A bidder that bids without complaining loses the right to challenge them.
What should a complaint contain?
Which breach is alleged, which rule is affected and what the bidder wants changed. It must be addressed to the buyer, not to the procurement chamber.
