What Is the Duty to Tender Competitively (Kilpailuttamisvelvollisuus, Finland)?

This is a Finnish procurement term. The core requirement of the Procurement Act that bodies using public funds must run their procurements through an open competitive tender.

Who is bound by the duty?

Contracting authorities as defined in the Procurement Act: state and municipal authorities, bodies governed by public law, and other entities where the procurement is largely publicly funded.

When does the duty not apply?

Below the national thresholds, for in-house procurement from an affiliated entity, and in the specific exceptions the Act allows for direct awards. The authority has to be able to justify the exception it relies on.

What happens if an authority ignores it?

The purchase is an unlawful direct award. The Market Court can declare the contract ineffective, shorten it or impose a sanction fee, and KKV can bring the matter before the court on its own initiative.
