What Is the EU Public Procurement Directive (2014/24/EU)?

This is an EU procurement law. The main EU directive for public procurement, setting the rules public authorities across the EU and EEA must follow when buying goods, services and works above the EU thresholds.

How does the directive affect national law?

EU and EEA countries must transpose it into their own legislation. That is why Sweden, Norway, Finland and Germany have similar procedures, principles and deadlines above the EU thresholds.

What does it regulate?

Procedures such as the open and restricted procedures, the competitive dialogue and the innovation partnership, plus exclusion grounds, selection criteria, award criteria, abnormally low tenders and contract modifications.

Is the directive being replaced?

The European Commission has proposed replacing it, together with the utilities and concessions directives, with a single EU Public Procurement Act. The proposal must still be negotiated and adopted, so the directive applies for now.
