What Are the EU Remedies Directives?
This is an EU procurement law. Two EU directives that give suppliers the right to challenge procurement decisions, covering review procedures, the standstill period and the remedies courts can order.
What do the Remedies Directives give suppliers?
The right to an effective and rapid review of procurement decisions, including suspension of the award, setting aside unlawful decisions and damages.
Where does the standstill period come from?
From the Remedies Directives, as amended by Directive 2007/66/EC. They require a pause between the award decision and signing the contract, so suppliers have time to challenge.
Which directive applies to whom?
Directive 89/665/EEC covers the public sector, and Directive 92/13/EEC covers utilities. National review bodies such as Swedish administrative courts, KOFA, the Finnish Market Court and German procurement chambers apply them.
