What Is an Ex-Ante Transparency Notice (Ex-Ante-Transparenz, Germany)?
This is a German procurement term. A voluntary notice published before an intended direct award, to create legal certainty.
What is an Ex-ante-Bekanntmachung?
A voluntary notice published before a direct award, announcing the buyer's intention to award without competition and the reasons.
Why would a buyer publish one?
To protect the contract. If no one challenges within ten days of publication, the contract cannot later be declared ineffective for lack of publication.
What should a supplier do if one appears?
Act fast. The ten-day period is the only window to challenge the direct award before it becomes immune.
