What Is an Excludable Supplier?

This is a UK procurement term. A supplier caught by a discretionary exclusion ground, which a buyer may — but is not required to — exclude.

What makes a supplier excludable?

Being caught by a discretionary exclusion ground, such as poor past performance, professional misconduct or insolvency, where the circumstances are likely to occur again.

Must the buyer exclude an excludable supplier?

No. The buyer decides, taking into account the evidence and any self-cleaning measures.

How can a supplier reduce the risk?

By explaining the circumstances openly and providing evidence that the issue has been dealt with and is unlikely to happen again.
