What Is the German Federal Budget Code (BHO)?
This is German law. The German law governing federal budget management, historically one basis of German procurement law.
What does the BHO have to do with procurement?
Section 55 requires federal bodies to procure through public competition unless the nature of the transaction or special circumstances justify an exception. Below-threshold procurement law rests on it.
Does it apply to states and municipalities?
Not directly. Each state has its own budget code with an equivalent provision, and municipalities follow their municipal budget rules.
Can suppliers rely on it?
Only indirectly. It binds the authority internally and is not enforceable before the procurement chamber.
