What Is the German Federal Court of Justice (Bundesgerichtshof)?
This is a German court. Germany's highest civil court, which rules on procurement matters only where the procurement senates of the higher regional courts disagree.
When does the BGH decide procurement cases?
Only when a higher regional court wants to depart from the decision of another higher regional court or of the BGH itself, and refers the question. It is not an ordinary appeal instance.
Why do its decisions matter?
They settle disputed questions of procurement law for the whole country, and the procurement chambers and senates follow them.
Does the BGH also decide below-threshold cases?
Yes, as the highest civil court, in damages claims that reach it through the ordinary courts.
