What Is Hankintalaki, the Finnish Public Procurement Act?

Hankintalaki (laki julkisista hankinnoista ja käyttöoikeussopimuksista, 1397/2016) is Finnish law. It is the main act governing public procurement and concession contracts in Finland and implements the EU Directives 2014/24/EU and 2014/23/EU, including national rules for procurements below the EU thresholds.

Who is covered by Hankintalaki?

State and municipal authorities, bodies governed by public law, and other entities whose procurement is mainly publicly funded. Utilities-sector entities follow the separate Erityisalojen hankintalaki instead.

Does the Act apply below the EU thresholds?

Yes. It sets national thresholds below which it does not apply at all, and lighter national rules between those and the EU thresholds. The national thresholds are stated in the Act and should be checked against the current figures.

Which procedures does the Act allow?

Open and restricted procedures, the negotiated procedure, competitive dialogue, innovation partnership, dynamic purchasing systems and, within defined exceptions, direct award.
