What Is the EU Foreign Subsidies Regulation (FSR)?
This is an EU procurement law. An EU regulation that lets the European Commission investigate subsidies from non-EU countries that distort competition, including in large public procurements.
When does the FSR apply in procurement?
Bidders must notify or declare foreign financial contributions in procurements with an estimated value of at least EUR 250 million, when the contributions they received exceed set limits.
What can happen if a bid is subsidised?
The Commission can investigate and, if foreign subsidies give an unfair advantage, prohibit the award of the contract to that bidder.
What does it mean for suppliers?
For very large tenders, check early whether a notification is needed. Missing it can lead to fines and to the bid being rejected.
