What Is a Formal Complaint (Rüge, Germany)?
This is a German procurement term. A bidder's formal objection to a contracting authority over a suspected breach of procurement rules.
What is a Rüge?
A bidder's formal objection to the buyer that a rule has been breached, for example an unlawful requirement or an incorrect evaluation. It must precede any application for review.
What is the deadline?
Ten calendar days from recognising the breach. Breaches visible in the notice or documents must be raised by the application or tender deadline.
What should it contain?
The breach, the rule concerned and what you want changed, in writing, clearly identified as a complaint. A vague question does not count.
