What Is the GWB?
The GWB (Gesetz gegen Wettbewerbsbeschränkungen) is German law. Part 4 of the act contains the core rules for public procurement above the EU thresholds in Germany, including the procurement principles, the types of procedure, the exclusion grounds and the review procedure before the procurement chambers.
The detailed procedural rules are set out in regulations such as the VgV, SektVO and KonzVgV.
What does Part 4 of the GWB cover?
The principles of procurement, the definition of contracting authorities and public contracts, the exclusion grounds, the types of procedure, self-cleaning, and the review procedure before the procurement chambers.
Does it apply below the EU thresholds?
No. Below them, procurement is governed by budget law, the UVgO and state procurement laws, and the review procedure is not available.
How does it relate to the VgV?
The GWB sets the frame. The VgV, SektVO, KonzVgV and VSVgV contain the detailed procedural rules for each type of procurement.
