What Is an Infringement Fee (Overtredelsesgebyr, Norway)?
This is a Norwegian procurement term. A fee KOFA or the courts can impose, among other things for unlawful direct awards.
When can an infringement fee be imposed?
Mainly for unlawful direct awards, and where a contract has been signed in breach of the standstill period or a suspension order.
Who imposes it and how large is it?
KOFA, or the courts in a court action. The fee is capped at a share of the contract value, and the cap should be checked against the current rules.
Who receives the fee?
The state. A supplier that has lost out is compensated separately, through a claim for damages.
