What Is an Interim Injunction in Procurement (Midlertidig forføyning, Norway)?
An interim injunction is a temporary court order that stops a contracting authority from signing a contract until a dispute about the procurement has been decided.
When is an interim injunction used?
When a supplier needs to stop the contract being signed while a dispute is being decided. Once the contract is signed, the realistic remedy is usually damages rather than getting the contract.
What does the supplier have to show?
That there is a real claim, and that there is a reason the decision cannot wait for an ordinary judgment. The court weighs the harm to each side.
Does the buyer have to wait for the court?
Once an injunction is granted, yes. During the standstill period alone, the buyer can sign as soon as the period expires unless it chooses to wait.
