What Is Judicial Review (Överprövning, Sweden)?
This is a Swedish procurement term. A supplier's request to the court to review an ongoing procurement, on the grounds that an error has occurred.
When can you apply for a review?
Up until the contract has been signed, in practice usually during the standstill period. After that, the remaining option is to apply for the contract to be declared invalid.
What do you need to succeed?
The supplier must show that the authority has breached the rules and that the breach has caused, or may cause, the supplier harm.
Does it cost anything to apply for a review?
There is no application fee in the administrative court, and the parties normally bear their own costs, for example for legal representation.
