What Is KOFA?
KOFA (Klagenemnda for offentlige anskaffelser) is a Norwegian body that handles complaints about breaches of the public procurement rules. Its decisions are advisory, but KOFA can impose infringement fees for unlawful direct awards.
KOFA is a lower-cost alternative to taking a dispute to the courts.
What can KOFA decide?
Whether a buyer has breached the procurement rules. Its opinions are advisory, but they are followed in practice and widely used as guidance. For unlawful direct awards it can impose binding infringement fees.
How does KOFA differ from the courts?
KOFA is faster, cheaper and only gives opinions. The courts give binding judgments, award damages and can set contracts aside.
Can a supplier use a KOFA opinion afterwards?
Yes. A KOFA finding of breach is often the basis for a later damages claim or a complaint to the buyer.
