What Are Liquidated Damages (Dagmulkt, Norway)?

This is a Norwegian procurement term. A pre-agreed penalty a buyer can charge per day of delay, without having to prove the actual financial loss.

How do liquidated damages work?

The contract sets a fixed amount per day of delay, which the buyer can charge without having to prove an actual financial loss. There is normally a cap on the total.

Can the buyer also claim ordinary damages?

Usually not for the same delay. Liquidated damages normally replace a claim for the loss caused by the delay, unless the contract says otherwise or the supplier has acted grossly negligently.

What should a supplier check before bidding?

The daily rate, the cap, what triggers the clock, and whether delays caused by the buyer stop it. Those terms decide the real risk in the contract.
