What Is Negotiated Procedure?

A procurement procedure in which the contracting authority negotiates the terms of the contract with selected suppliers.

When can a negotiated procedure be used?

When the need cannot be met without adapting existing solutions, when it involves design or innovation, when the contract cannot be awarded without negotiation because of its nature, or when a prior procedure produced only irregular bids.

What can be negotiated?

The content of the bids, to improve them. Minimum requirements and award criteria stay fixed, and all bidders must be treated equally.

Does it always involve a prior notice?

Normally yes. The negotiated procedure without prior publication is a separate exception, allowed only in specific circumstances such as extreme urgency or a single possible supplier.
