What Is Negotiated Procurement Below Threshold (Förhandlad upphandling, Sweden)?

This is a Swedish procurement term. A below-threshold Swedish procedure where the contracting authority invites a number of selected bidders to negotiate improvements to their bids.

When can a negotiated procedure be used?

For example when the need cannot be met without adapting existing solutions, when the contract involves design or innovative solutions, or when an earlier open or restricted procedure only produced unacceptable bids.

What can be negotiated?

The content of the bids, but not the minimum requirements or the award criteria. All bidders must be treated equally and receive the same information.

Does the authority have to negotiate?

No. The authority can reserve the right to award the contract on the basis of the initial bids without negotiation.
