What Is the Open-House Model (Open-House-Modell, Germany)?
This is a German procurement term. A model in which the contracting authority concludes contracts on fixed terms with all suitable providers, without any selection.
What is the Open-House-Modell?
A model in which the buyer publishes fixed terms and concludes a contract with every supplier that meets them and wishes to join. There is no selection, so it is not a procurement.
Where is it used?
Mainly in the healthcare sector, for example rebate contracts between health insurers and pharmaceutical companies.
Why is it not a procurement?
Because the buyer makes no choice between suppliers. The Court of Justice confirmed that such models fall outside the procurement directives.
