What Is a National Open Tender (Öffentliche Ausschreibung, Germany)?
This is a German procurement term. The national standard procedure in which an unlimited number of companies are invited to submit a bid.
What is an öffentliche Ausschreibung?
The standard below-threshold procedure in which the buyer publicly invites an unlimited number of companies to submit bids. It is the national counterpart of the open procedure.
Is it the default?
Yes, under the UVgO and the VOB/A section 1. The restricted and negotiated procedures are only allowed where the rules permit them.
Can the buyer negotiate?
No. As in the open procedure, negotiation is prohibited. Only clarification of bids is allowed.
