What Is a Procurement Chamber (Vergabekammer, Germany)?

This is a German review body. The first-instance body in Germany that reviews complaints about above-threshold procurement decisions, before any appeal goes to the Higher Regional Court's procurement senate.

What does the Vergabekammer decide?

Applications for review of procurements above the EU thresholds. It can order the buyer to correct the procedure, repeat the evaluation or cancel the tender, and it decides on the award suspension.

How quickly does it decide?

Within five weeks of the application, extendable in complex cases. The procedure is written, with an oral hearing as a rule.

What does it cost?

A fee between 2,500 and 50,000 euros depending on the value of the contract, plus the other side's costs if the application fails.
