What is Beschaffungscharakter?
The feature that the contract serves to obtain goods, services or works for the buyer's own needs. It is a precondition for a public contract under the GWB.
What lacks it?
Grants without consideration, transfers between public bodies without a procurement purpose, and arrangements where the public body is the seller rather than the buyer.
Why does it matter?
Because without procurement character, procurement law does not apply, however large the sum involved.
