What Is the Procurement Damages Fee (Upphandlingsskadeavgift, Sweden)?
This is a Swedish legal sanction. A fine the Swedish Competition Authority can apply to have a court impose on a contracting authority that has breached procurement law.
How large can the fee be?
At least SEK 10,000 and at most SEK 10 million, and no more than ten per cent of the contract value.
Does the supplier receive any of the fee?
No, the fee goes to the state. A supplier that has suffered a loss can instead claim damages.
When can a procurement damages fee be imposed?
For example after an unlawful direct award, when a contract has been signed in breach of the standstill period, or when a court has allowed a contract to stand even though it should have been declared invalid.
