What Is Procurement Law (Vergaberecht, Germany)?
This is a German procurement term. The body of rules governing the award of public contracts.
What does Vergaberecht consist of?
Above the EU thresholds: the GWB and the regulations VgV, SektVO, KonzVgV and VSVgV, plus VOB/A section 2. Below them: budget law, the UVgO, VOB/A section 1 and the state procurement laws.
What is its purpose?
To ensure that public contracts are awarded through competition, transparently and without discrimination, so that public money is spent well.
Is it federal or state law?
Both. The GWB and regulations are federal. Below the thresholds, each state has its own procurement law with its own value limits and additional requirements.
