What Is Proportionality in Procurement?

The requirement that requirements and conditions be in a reasonable proportion to the nature and scope of the procurement.

What does proportionality require?

That requirements, criteria and contract terms are reasonable in relation to the nature, value and complexity of the contract. A small contract cannot carry the same requirements as a large one.

What are typical breaches?

Turnover requirements far above the contract value, demanding certifications the contract does not need, or liability caps out of all proportion to the risk.

How can a supplier use it?

By asking the buyer during the tender period to justify a requirement that seems excessive. Buyers often adjust requirements when challenged on proportionality.
