What Is the Publication Duty (Kunngjøringsplikt, Norway)?

This is a Norwegian procurement term. The duty to advertise the competition publicly once the value exceeds the relevant threshold.

When does the publication duty apply?

Once the estimated value exceeds the national threshold. Above the EEA thresholds the notice must also go to TED. Below the national threshold the buyer may advertise but need not.

Where is the notice published?

In Doffin, which forwards notices above the EEA thresholds to TED.

What happens if a buyer does not publish when it should?

The procurement is an unlawful direct award. KOFA can impose an infringement fee and the contract can be set aside.
