What Is a Rejection Letter (Absageschreiben, Germany)?

A rejection letter is the notice a contracting authority sends to a bidder whose bid has not been successful, stating the reasons. In many systems it must be sent before the contract is signed, so that the bidder has time to challenge the decision.

What is an Absageschreiben?

The notice to unsuccessful bidders that their bid was not chosen, with the reasons and the name of the winner. Above the thresholds it is the Vorabinformation under section 134 GWB.

When must it be sent?

Before the contract is signed, so that the standstill period of fifteen days, or ten if sent electronically, can run.

What should an unsuccessful bidder do with it?

Read the reasons carefully. If they suggest an error in the evaluation, lodge a formal complaint within the standstill period.
