What Is a Reservation in a Tender (Forbehold, Norway)?
This is a Norwegian procurement term. A supplier's express reservation against one or more of the terms in the tender documents.
What is the risk of taking a reservation?
If the reservation concerns a material element, the bid must be rejected. If it is minor, the buyer may accept it but will normally price the uncertainty into the evaluation.
How should a reservation be worded?
Clearly and explicitly, stating which clause it concerns and what the supplier proposes instead. Vague reservations are often read as material.
Is there a better way to raise a concern?
Yes. Ask about the term during the tender period as a clarification question. A reservation in the bid is a last resort.
