What Is LUK, the Swedish Concessions Procurement Act?
LUK (lagen om upphandling av koncessioner, SFS 2016:1147) is Swedish law. It governs the award of works and services concessions, where the supplier's payment consists wholly or partly of the right to exploit the works or service, and implements EU Directive 2014/23/EU.
What is the difference between a concession and an ordinary contract?
In a concession, the supplier bears an operating risk, because its income depends on how much the service or facility is used. In an ordinary contract, the authority pays an agreed price.
What are examples of concessions?
Running a car park, a restaurant in a public building, or a ferry route where the supplier charges the users.
How does LUK differ from LOU?
LUK gives the authority more freedom to design the procedure, but the principles of equal treatment, transparency and proportionality apply in full.
