What Is LUFS, the Swedish Defence and Security Procurement Act?

LUFS (lagen om upphandling på försvars- och säkerhetsområdet, SFS 2011:1029) is Swedish law. It applies to purchases of military equipment and security-sensitive goods, services and works, and implements EU Directive 2009/81/EC.

LUFS gives buyers more room to protect security-of-supply and confidentiality interests than LOU does.

Who uses LUFS?

Mainly authorities in the defence and security field, such as the Swedish Defence Materiel Administration (FMV) and the Swedish Armed Forces, but also other contracting authorities when they buy defence- or security-related goods and services.

How does LUFS differ from LOU?

The negotiated procedure with prior publication can be used freely, and the authority can set specific requirements on information security and security of supply.

Can procurements be exempt from LUFS?

Yes. Certain procurements involving essential security interests can be exempt from the act.
