What Is LOV, the Swedish Freedom of Choice Act?
LOV (lagen om valfrihetssystem, SFS 2008:962) is Swedish law. It lets municipalities and regions set up freedom-of-choice systems, where every supplier that meets the published requirements is approved and the citizen chooses the provider — common in home care and primary care.
LOV is not a procurement act in the EU sense: there is no competition on price between suppliers.
Is LOV a form of procurement?
Not in the LOU sense. There is no price competition: every supplier that meets the requirements is approved, and the payment is set in advance.
How do you become a supplier in a freedom-of-choice system?
By applying once the system has been advertised. Applications can usually be submitted on a rolling basis, and anyone who meets the requirements must be approved.
Can a decision under LOV be reviewed?
Yes. A supplier that has not been approved can apply to the administrative court for correction.
