What Is LUF, the Swedish Utilities Procurement Act?
LUF (lagen om upphandling inom försörjningssektorerna, SFS 2016:1146) is Swedish law. It governs procurement by entities operating in the water, energy, transport and postal sectors, and implements EU Directive 2014/25/EU.
LUF is generally more flexible than LOU, for example in the free choice between procedures and in how qualification systems can be used.
Who is covered by LUF?
Contracting entities, which can be authorities, publicly controlled companies or private companies with special or exclusive rights in the sector.
How does LUF differ from LOU?
Among other things, LUF has higher thresholds, a free choice between more procedures and the possibility of longer framework agreements.
Does LUF apply to everything an energy company buys, for example?
No, only to purchases made for its activity in the utilities sector. Other purchases may instead fall under LOU, depending on who the buyer is.
