What Is a Transparency Requirement (Transparenzgebot, Germany)?
This is a German procurement term. A principle obliging the contracting authority to make its procedural decisions traceable and to disclose them.
What does the Transparenzgebot require?
That the procedure is published, the criteria and their weighting are known in advance, decisions are documented and explained, and the process can be checked afterwards.
How is it enforced?
Through the procurement file, the information duties towards bidders and the review procedure. A breach of transparency is one of the most common grounds for a successful application.
Does it override confidentiality?
No. Transparency concerns the process. Bidders' trade secrets and the content of competing bids remain protected.
